According to an arrest affidavit, Strait entered the Whataburger at FM 78 and Walzem Road around midnight last Thursday. At around 2 a.m., she locked herself in the bathroom and stayed there for several hours, making noises that concerned employees.
The restaurant staff offered her water and assistance, but Strait reportedly refused to leave. They eventually called 911 for help.
Discovery in the Bathroom
Deputies from the Bexar County Sheriff’s Office arrived and detained Strait. Firefighters who also responded found what was described as “human-like material” in the restroom.
Inside the toilet, they discovered a baby girl still in the amniotic sac. Both the baby and Strait were rushed to the hospital. Doctors later pronounced the baby dead.
Possible Signs of Harm
According to the affidavit, the baby appeared to have head injuries, suggesting she may have been forced into the toilet. Strait reportedly told first responders on the way to the hospital, “I’m sorry, I’m not selfish.”
The baby girl was estimated to have been born between 28 and 30 weeks into the pregnancy.
Investigation Ongoing
Authorities are waiting for an autopsy to determine the cause of death. If the investigation finds that Strait intentionally harmed the baby, her charges could be upgraded.
Texas Safe Haven Law
Texas has a Safe Haven Law, also known as the Baby Moses Law, which allows parents to safely and anonymously leave their babies at a hospital or fire station within 60 days of birth, without fear of prosecution.
